We shall not rest

Last week’s events at Bidnija are horrifying, to say the least. A person was violently murdered but we all know there are many other layers of meaning laid bare by the homicidal act. We feel that the evil perpetrated affects us as a whole because the crime assaulted our values, our democracy and disturbs our human, civic and (where applicable) Christian conscience. Our dignity has been trampled upon. Not only because a voice was silenced but also because a system, a perverse system, I would add, has given room for this to happen. I am not referring first and foremost to state institutions, lawmakers or politicians. That would perhaps provide us with an easily-available scapegoat. I am referring to a structure of being, which condones a growing intolerance, unable to foster a peaceful and respectful exchange of ideas, resulting in an ever-increasing vertigo of violence, ranging from arguments ad hominem, where the opponent is ridiculed or personally attacked, to character assassinations up to the insanity of physically eliminating the opponent killing him brutally, preponderantly. We ask for justice, not revenge. Delving even deeper in the precipice of violence is solely and...

The pen conquers fear

There are various schools of thought on whether so-called citizen journalism is good or bad. Some say it widens the dissemination of information. Others complain it only serves for fake news to spread like wildfire. In journalism, fact is sacred and comment is free but both are essential ingredients in a well-written article, provided a clear distinction is made. The same can apply to professional and citizen journalism. Citizen journalism can have a very useful function if it serves as an extension of the eyes and ears of professional journalists. News gathering and, especially, confirming its authenticity, is no mean feat. It takes time and energy and can also involve an element of personal risk to the professional journalist working on a story. The job becomes even more difficult, and dangerous when dealing with sensitive issues, in a small and tightly-knit society like Malta, where, as was only pointed out recently, omertà – the code of silence – is practised at both a national and local level. Journalists accepted such risks as hazards of the trade until the unthinkable happened exactly a week ago. Journalist/blogger Daphne Caruana Galizia paid with her life for doing her...

Autonomous communities

I refer to the article ‘Spain to suspend Catalonia autonomy after threats of formal independence’ (October 20). In view of the attention this newspaper gives to the political situation in Spain and for the sake of accuracy, I would like to help readers understand that autonomy is not to be suspended in Catalonia. What the Parliament of Spain will decide in the coming days is about the restoration of constitutional legality and rule of law in the territory of Catalonia, which is being put in jeopardy by the Catalan authorities. I have taken the liberty to include below the text of article 155 of the Constitution of Spain, which will be activated in defence of legality, on the understanding that autonomy is the rightful situation of Catalonia. I would like to point out that this constitutional instrument is not, in any way, a measure of state of exception or of suspension of autonomy. Article 155 of the Constitution of Spain has practically the same content of article 37 of the Basic Law of the Federal Republic of Germany. Article 155 of the Spanish Constitution states: “1. If an autonomous community does not fulfil the obligations imposed upon it by the Constitution or other...

$17,000 in undeclared cash seized by customs

More than $17,000 in undeclared cash were seized by customs officials stationed at the airport last night. The cash was being carried by an Omani national who arrived in Malta from Benghazi on a private flight. He failed to declare to customs that he was carrying $27,000. When passing through the customs screening area, customs officials found the bundles of cash as well as six cartons of undeclared duty free cigarettes. The excess cash as well as the cigarettes were seized by customs pending investigations by the Police Economic Crimes unit. The passenger will be arraigned in court in the coming days. Customs said this has been a record breaking year for the department in terms of cash control seizures.

Study on the rule of law being commissioned by Chamber of Advocates

A study to analyse structural deficiencies in the legal framework and the checks and balances intended to create the right balance between and within the different organs of the state is being commissioned by the Chamber of Advocates. In a statement this morning, the Chamber referred to the current situation in Malta and the apparent perception of a number of people, including some of its own members, that the rule of law was under unprecedented pressure. It said it believed it was critical in a democracy that all the country’s citizens, without exception and without any shadow of doubt, should have the firm belief that there existed within the state the necessary checks and balances to ensure the supremacy of law. “Any doubts or perceptions that this may not be the case are a serious concern to the chamber and cannot be easily dismissed. These doubts and perceptions can be the product of a number of factors, not least that the infrastructure of checks and balances intended to safeguard the rule of law are outdated and need to be strengthened to meet today’s new challenges; a mentality where anything goes; where profit or pecuniary advantage have priority over other values, such...
