Miguel Ángel Fernández stood alone on the Constitutional Tribunal as the court disposed of the government's challenge to the basic services law. The full bench ruled on Article 31 of the sweeping reform, voting 9 to 1 against admitting the recourse. A majority of judges held that the provision was tied to the core ideas in the legislative message. Fernández, appointed in 2018 by former president Sebastián Piñera, was the only magistrate willing to take up the government's case.

La mayoría del pleno consideró que el precepto tenía relación con las ideas matrices del mensaje. El único disidente fue el magistrado Fernández quien fue designado en 2018 por el expresidente Sebastián Piñera.
