No EC nod needed for voter to sue candidate over false information: Supreme Court
Full story
The Supreme Court overturned a Karnataka High Court ruling regarding the rights of voters. The previous order stated that voters could only file election petitions rather than private criminal complaints. This decision meant that registering a crime was the sole duty of the Election Commission. The current bench of justices ruled that a voter does not need a nod from the Election Commission to sue a candidate over false information.
A bench of Justices Dipankar Datta and Sheel Nagu quashed the Karnataka HC order which had held that “right given to the voter is only to file an election petition, and not to register a private complaint of crime which is the duty of the Election Commission, if it wants to do so”.
