Adopted on 17 July 1998, the Statute of Rome is the founding treaty of the International Criminal Court, which was set up to deal with the most serious crimes of international concern, namely genocide, crimes against humanity and war crimes. Its establishment has inspired much hope that the most horrendous crimes will no longer go unpunished and that its deterrent effect will significantly reduce their occurrence. The EU has been a strong supporter of the ICC system from the outset. Since it began operating in 2003, the Court has conducted investigations and trials in connection with some of the world's most brutal conflicts and has not shied away from investigating individuals at the highest level of power, such as presidents in office. It has developed extensive tools to protect its most important asset – the witnesses, who in many cases have faced intimidation, violence and even death. However the Court has also encountered difficulties and inherent limitations. The atrocities committed by groups such as ISIL/Da'esh have been out of reach for the Court's jurisdiction, which is limited to states parties' territories and their nationals, unless the Security Council specifically asks it to investigate. The refusal by some major powers such as the US, China and Russia to join, the lack of cooperation by some states parties such as South Africa, as well as recent defections or the threat thereof have also put strains on its global authority. The Court's effectiveness cannot be judged solely on the convictions it passes. The ICC is a court of last resort, and its impact on national judicial systems has also been significant. The Rome Statute itself has evolved. At the end of last year, the jurisdiction of the Court was extended to cover the crime of international aggression and new war crimes taking into account the latest technological developments. Currently, there are at least 86 different versions of ID cards, and 181 types of residence documents in circulation in the EU. The format and minimum standards for ID cards and residence documents is not regulated on EU level. In order to strengthen the security features of ID cards and residence documents of EU citizens and their non-EU family members, the European Commission published a legislative proposal. The impact assessment accompanying this proposal clearly explains the problems currently encountered, and proposes adequate solutions. The Commission used different sources to substantiate the impact assessment and also undertook several stakeholder consultation activities. However, it is not systematically indicated which stakeholder group prefers which specific option. At times the impact assessment displays a lack of quantification, about which the Commission is open. Moreover, stakeholders’ views are mentioned in a rather general way throughout the IA report and also, the problem drivers are not evenly discussed. It is to be noted that the proposed Regulation does not entirely follow the IA as it does not include legislative measures on direct access and access to databases, and on the other hand, it includes additional conditions for issuing a European Production Order. In order to improve the EU road safety and substantially reduce road deaths, several measures were taken at the EU level. A general policy document was adopted in 2010, when the European Commission published the Road Safety Programme 2011-2020. The current revision of the road safety management procedures was triggered by the fact that the progress in the reduction of road fatalities stalled and that the existing road security measures needed to be adapted to changes in mobility resulting from societal trends and technological developments. The impact assessment accompanying this proposal clearly explains the problems currently encountered, and proposes adequate solutions. The Commission used different sources to substantiate the impact assessment and also undertook several stakeholder consultation activities. However, some parts of the IA do not entirely follow the requirements of the Better Regulation Guidelines in that it does not set sufficiently specific and time-bound objectives. The fragmentation of EU administrative law impinges on the EU’s ability to consistently uphold standards of good governance and administration, as well as to protect citizens’ rights when they interact with the administration. The impact assessment analyses what action could be taken to guarantee an open, efficient and independent EU administration. It compares the option of “doing nothing” with two alternative policy options. The study concludes that adopting a regulatory framework for administrative procedures would be the preferred option, since it would lead to clear advantages in terms of cost savings for the public, as well as the accessibility, transparency, legal certainty and predictability as well as the legitimacy of, and trust in, EU institutions. Briefing - Limits on exposure to carcinogens and mutagens at work: Third proposal - 12-07-2018

The European Commission has proposed to amend Directive 2004/37/EC by expanding its scope and by including and/or revising occupational exposure limit values for a number of cancer- or mutation-causing substances. The initiative is proceeding in steps. The first proposal of May 2016 covered 13 priority chemical agents, the second, of January 2017, a further seven. The current (third) proposal addresses an additional five. Broad discussions with scientists and the social partners fed into all three proposals. Reacting to the Commission's set of measures as a whole, trade unions have acknowledged the importance of further action to improve the existing framework, reiterating the need to reach the target of 50 limit values in 2020, while some considered it necessary to extend the scope of the CMD to substances that are toxic to reproduction. Actors on the employers' side, while in principle supporting further revisions of the directive, have underlined, among other things, the need to ensure that values are proportionate and feasible in terms of technical implementation. While welcoming the Commission proposal, the rapporteur's draft report of 29 June 2018 proposes, inter alia, to grant incentives to businesses that comply with the directive. Moreover, it opts to include, within the scope of the directive, the protection of workers from exposure to hazardous, or harm-causing, medicines (including cytotoxic ones, which are used in the treatment of cancer). Directive 2011/7/EU on late payments in commercial transactions (Late Payment Directive, (LPD)) strengthened European regulations first introduced in 2000 in favour of creditors. In addition to statutory interest, the application of which is still not automatic, maximum periods were established for payments in business-to-business transactions and those with public authorities, limiting contractual freedom, which is often abused by stronger companies. Following the largely correct transposition into national law, the situation continues to vary between Member States with regard to average payment periods (especially from public authorities), and the level of implementation of additional voluntary measures (such as prompt payment codes). In the absence of harmonised measurement methods, business surveys and consultations indicate improving practices, but the attribution of this development to the LPD cannot be separated from broader economic contexts and cultural aspects easily. Further exchange of best practices and better monitoring of their effectiveness might facilitate future developments in the area of late payments, including legislative action. Just three decades after the fall of the Berlin Wall signifying the end of Cold War aggression and the ascendancy of international liberalism, the world faces even greater uncertainty. In every region of the world, geopolitical shifts are taking place that have brought offensive trade agendas to the fore. The US has withdrawn from underwriting the post-World War Two international economic and foreign policy architecture, instead proposing to build a wall between itself and neighbouring Mexico, imposing unilateral tariff increases while refusing to negotiate new international agreements. In Europe, the project of ever greater integration has been attacked by Brexit, as well as other populist sentiment against the perceived power of EU institutions and the forces of globalisation. The breakdown of the western coalition advocating global governance has left a power vacuum that other key players such as China are forced to respond to. These current tectonic shifts in power and foreign policy positions impact on every country and every individual in the early 21st century. While many governments strive to maintain international cooperation and further integration, it is an unpredictable era. For trade policy has established itself firmly within the arena of high foreign diplomacy and as a result, traditional assumptions and adherence to international norms can no longer be assumed in such a state of political and economic flux. Yet when trade policy becomes a tool of diplomacy and foreign policy, sound economic reasoning can be lost to political decision making. This report shines a spotlight on the rise of protectionism in the 21st century. It examines the diplomatic dynamics behind economic nationalism and its attack on the established liberal international institutions that were created after the second World War to settle disputes without recourse to war. Before focusing on the US, UK, EU and China, the first chapter centers on the threat to economic integration and cooperation in promoting sustainable development through the multilateral rules-based system established under the World Trade Organization. Effective air quality policies require action and cooperation beyond the local and national levels, on a European and global scale. This publication presents key air pollutants, lists natural sources of air pollution, and details emissions from human activities by sector. It describes adverse effects on human health, the environment and the climate, as well as socio-economic impacts. In addition, it provides an overview of international agreements and European Union legislation setting air quality standards, lowering national emissions of pollutants, and reducing emissions of pollutants at specific sources. Furthermore, this publication briefly describes the state of implementation of key EU legislation related to air quality. NATO heads of state or government will meet in Brussels on 11 and 12 July for a keenly awaited summit. Some analysts and diplomats fear a tense atmosphere, following US President Donald Trump’s tough treatment of European allies at a recent meeting of the G7 group of developed countries, and his imposition of steep tariffs on imports of steel and aluminium from the EU. President Trump is expected to pressure many NATO members to increase their military spending level to the agreed 2 % of GDP guideline, with particular emphasis on Germany. The NATO summit precedes President Trump’s meeting with Russian President Vladimir Putin on 16 July in Helsinki, where some analysts speculate some rapprochement might take place. President Trump’s unpredictability and his widely criticised attitude towards President Putin is causing unease at home and abroad regarding the potential outcome of this summit. Explosives precursors can be found in various chemical products used by consumers, general professional users, and industrial users, for example, in detergents, fertilisers, special fuels, lubricants and greases, water treatment chemicals. They can be used by terrorists to produce home-made explosives (HME). In April 2018 the European Commission put forward a proposal for a new regulation, accompanied by an impact assessment (IA) and an evaluation, which have been performed at the same time. The IA has attempted to provide a rather detailed, albeit mainly qualitative, analysis of the various types of impacts, disregarding some limitations to obtain data, such as a risk of exposing vulnerabilities in Member States and of jeopardising ongoing investigations and prosecutions. The IA notes that many SMEs are not part of the EU level industry associations, which have been consulted while drafting the ex-post evaluation. A question arises if the SMEs have been targeted at the stakeholder consultation in any other way, which appears not to be the case.
