Since it was set up in 2007, the EU Agency for Fundamental Rights has demonstrated its ability produce high-quality research, and to provide the EU institutions and the EU Member States implementing Union law with expert advice on fundamental rights issues. The regulatory framework under which the Agency operates, however, is not fully appropriate to discharge its mandate effectively. Study - Blockchain for supply chains and international trade - 29-05-2020

Blockchain could benefit supply chain management and international trade processes. See the new STOA study of potential use cases, their impacts, and potential policy responses. There are no major technical barriers to the use of some types of blockchain solution for some elements of trade. Many of the benefits of blockchain for trade derive from digitalisation, which could be achieved through other means. There remain substantial barriers to digitalisation of trade processes. Barriers to blockchain in supply chains and international trade include legal recognition, data localisation, identification of applicable laws, allocation of liability, and interoperability and standardisation across various economic operators and regulatory frameworks. 20 policy options for blockchain in supply chains and international trade including supporting customs facilitation, sustainable trade, SME involvement, leadership in standardisation, evidence-based policy and awareness raising. Study - Unlocking the potential of the EU Treaties: An article-by-article analysis of the scope for action - 28-05-2020

The latest Eurobarometer surveys indicate that there is consistent support for more EU action in various policy areas, including preventing climate change, tackling irregular migration, designing a common foreign and security policy and preventing terrorism. Assuming that the Treaty of Lisbon will be the framework for EU action for the foreseeable future, this paper explores possibilities for broadening the scope of EU action in order to respond to these repeated calls from EU citizens. With a view to reappraising the legal framework of the EU, it aims at identifying those legal bases in the Treaties that remain either under-used (in terms of the purposes they could be used to achieve) or completely unused. It analyses possible ways of delivering on EU policies, including in the development of common rules, providing enhanced executive capacity, better implementation of existing measures, targeted financing and increased efficiency. An overview table sets out possible initiatives, which are then explored in greater detail in 50 fiches, organised according to broad policy clusters reflecting the priorities of the von der Leyen Commission. Possible measures are mentioned in each fiche, along with the legal bases in the current Treaties on which action could potentially be based. It is a revised and expanded version of a paper published in January 2019, ahead of the European elections. Source : © European Union, 2020 - EP

As the coronavirus crisis keeps the world in its grip, analysts ponder what future measures could stimulate recovery from the deep recession expected in its aftermath, with a focus, in particular, on the European Commission’s plans and the growth-boosting fund recently proposed by France and Germany. Analysts also continue to contemplate what geopolitical order will emerge from the crisis, as well as the impact on individual regions such as Europe, Africa and Asia, or particular countries such as Saudi Arabia, Japan or Syria. This note offers links to recent commentaries and reports from international think tanks on coronavirus and related issues. In-Depth Analysis - The ECB’s Mandate and Legal Constraints - 15-05-2020

This paper considers how the ECB can implement its mandate in the current crisis conditions and the legal constraints that exist on its actions. The current position of the euro area economy means the threat to meeting the ECB’s primary objective of price stability stems from the possibility of a long period of below-target inflation. This means the ECB should consider a wide range of stimulative policies that would help it meet both its primary and secondary objectives. The ECB, however, will be constrained by the ECJ’s interpretation of the monetary financing clause and its ability to meet its primary objective (and its independence) could be threatened by the recent German constitutional court judgement which is flawed in both its legal and economic analysis. Briefing - Constitutional change in Russia: More Putin, or preparing for post-Putin? - 27-05-2020

In January 2020, Russia's President, Vladimir Putin, opened the constitutional debate by outlining a series of amendments that, according to him, aimed to improve the balance of power and adapt the Constitution to the changes that had taken place since 1993, when the original text was adopted. With Putin's fourth and – as it seemed till recently – final presidency due to end in four years, observers speculated that the proposed amendments were intended to give Putin options for continuing to rule the country from behind the scenes, beyond 2024. Events took an unexpected turn in March 2020, when lawmaker and former cosmonaut, Valentina Tereshkova, tabled a last-minute amendment. Her proposal envisaged re-setting the clock for presidential terms, allowing Putin to stay on as president for another 12 years, should he choose to do so. Shortly afterwards, the bill was rubber-stamped by both houses of the federal parliament, and all of Russia's 85 regional parliaments. Altogether, the amendments revise nearly one-third of the Constitution's 137 articles. Apart from presidential term limits, they also clarify the role of Russia's main institutions, with some additional powers for the parliament. Reflecting growing nationalism and suspicions of liberal Western influences, other provisions bar senior government figures from holding foreign citizenship or bank accounts, give the Constitution primacy over decisions made by international bodies, and affirm traditional values. Socioeconomic changes include annual indexation of pensions and a guarantee that the minimum wage will not fall below the poverty threshold. Before they can come into effect, the amendments must first be approved by a nationwide vote on a date yet to be scheduled. Surveys suggest that public opinion is divided on the changes; as the economy deteriorates due to the coronavirus crisis, there is a growing risk of a 'no' vote, which would be an unprecedented setback for Putin. Briefing - Employment and disability in the European Union - 27-05-2020

Approximately one in six people in the European Union (EU) aged 15 and over lives with some kind of disability. Even if there has been an overall improvement in the employment situation of persons with disabilities in the EU (given the increase in employment rates), they still remain among the most disadvantaged groups as regards employment. This phenomenon considerably affects the EU's social integration ability and economic growth. Alongside and in support of Member States' policies, the EU has introduced a series of legal provisions, initiatives, actions and strategies to improve the employment situation of disabled people. In 2010, the EU signed the UN Convention on the Rights of Persons with Disabilities (CRPD), which is a legally binding international treaty. According to the CRPD, the right to work and employment is a fundamental right (Article 27). The main instrument supporting the CRPD's implementation in the EU is the European disability strategy 2010-2020. Its overall aim is to empower people with disabilities so that they can enjoy their full rights, participate in society and have equal access to employment as others. Since 2017, the European Pillar of Social Rights has provided further impetus to the active social inclusion of people with disabilities. In relation to the European disability strategy 2010-2020, the European Pillar of Social Rights and the European Semester (established in 2010 as an annual cycle for economic, social and fiscal policy coordination), the EU supports a number of initiatives designed to assist disabled people as regards employment. These include: non-discrimination, workplace adaptations, public employment services, accessibility, financial incentives and EU funding. Since the early 1980s, the European Parliament has given priority to combating all forms of discrimination against disabled people, in particular, as regards employment. Academics and stakeholders share the view that tackling any kind of discrimination against, and fostering the active inclusion of, people with disabilities in the labour market are equally important for the EU's economy and society.
